Abstract

This critical letter analyzes the functional mobility modalities for faculty members of Brazilian federal educational institutions (IFEs) within the legal framework up to 2024. The study focuses on the theoretical and practical distinction between the institutes of removal (remoção) and redistribution (redistribuição), based on Laws No. 8,112/1990 and No. 12,772/2012. It discusses the role of the Superior Court of Justice (STJ) jurisprudence in consolidating the understanding of a single personnel framework within the Ministry of Education (MEC) for removal purposes, overcoming administrative obstacles based on university autonomy. The critical analysis highlights excessive bureaucracy and judicialization as barriers to faculty mobility and the protection of the family unit, concluding with the need for normative harmonization to ensure greater speed and legal certainty for federal professors.
